1934 -May 1939 Dampness and resultant legal action. House began to leak within six months, serious damp in walls and ceilings of bedroom and nursery, lounge, stairway, bathroom. Moran brought court case against McDonald senior in May 1939, for damages and breach of his contract to provide waterproof house. Due to mould growth, spongy plaster, Moran children had to share parents’ bedroom, and family moved out in Sept 1937. Sheriff found faulty roof construction, a fault ‘deep seated and chronic’, and not condensation was to blame, and awarded Moran £350 costs against McDonald. Sheriff Robertson described the building as ‘modernistic, namely the design is externally different from what is customary here. It rather resembles a band box. It has a flat roof with a low parapet ... and a smooth white cement external surface’.
